in 1863, new york state assembly tied, having 64 republicans , democrats each. election of speaker proved difficult. during stalemate, callicot offered republican leader chauncey m. depew deal: if republicans elect him speaker, callicot republicans elect u.s. senator new york. depew accepted, , on january 26, callicot elected speaker on 92nd ballot. shortly afterward, democrats accused callicot of improper , corrupt proceedings achieve election speaker , select committee appointed investigate. on april 20, assembly adopted majority report of select committee, declaring callicott entirely innocent.
